Fantastic news Paul I am so pleased for you, I have just sent off my latest medical evidence, My support worker said she cant possibly see how they can turn me down now. But this is the DWP and they as we know are capable of anything.

I dont know if I will win, That remains to be seen but I will carry on fighting, I dont think I will get the mobility part this time but like you Paul We can fight for that again.

I am so pleased for you , Lets hope that you will be a good omen for me and the winning streak will continue.

Thanks for all your best wishes and support.Yes gus sunny Weymouth is looking like a must have bolting  place after all this. I really like Weymouth and the people are so laid back its great.

Hi all

I have just got of the phone from the DWP who rang me to say they could not change there decision on whether I ger the mobility element of PIP.

Oh I said what happens now ( no mention of unplanned intervention or the form that was supposed to be sent out) The lady from the dwp said I had had my reconsideration and could not have another one so I would have to go to tribunal and appeal

My take on this is as follows

Calling my bluff to see if I just curl up and stop bothering them

They think I wont go to tribunal because I would be frightened of losing my enhanced daily living well that wont happen as the tribunal are only looking at my reasons for appeal in this case my inability to walk said distance safely reliably and in a reasonable time its  not the same as mandatory reconsideration were the whole claim is looked at again.

I now have to make up my mind I have a month to chew it over as of the 07/08/14 I feel like Clint Eastwood in dirty Harry  do ya feel lucky punk well do ya...................................Paul

So they wont stop your Daily enhanced living component if you go to a tribunal for mobility? Paul,

I would check and double check that before you decide, It would be hell of a shame if they stopped it if you decide to appeal.

I was under the impression that all parts of the claim were suspended if you go for appeal.

I may be wrong and I would hate for you to lose what you have fought so hard for.

I had a look on the disabilty rights website, The first tier appeal, I think thats the first stage can look at the whole claim again even if you are only going for one part of it.

You could lose what you have already been awarded, So please check this carefully.

What a awful situation to be in Paul , as Gus said most people who go to appeal have won i have read of a lot of cases on the disability forum  where people have lodged appeals and  the case has never got to appeal as once the papers are lodged  with the tribunal service dwp have backed down and awarded the claim

You have to do what you feel is the right thing , whatever you decide to do  we are all here to support you through it Paul

I would advise you take some advice maybe from your  puk support worker  and there is also the disability rights forum there is some excellent advice available on there , i am not sure but i dont think they suspend your daily living allowance as you have been awarded that i would think that would only stop if the decision was reversed at or before appeal  , but as i said on that i am not entirely sure so again as candy said check it out

Yes doing the right thing is of the utmost importance to me as a former trade union rep I firmly believe in what is right or wrong its the way I am made

No they dont suspend any money while your going through either mandatory reconsideration or tribunal you get whatever payment your decision letter states prior to appeal

I got my decision letter today in duplicate so here goes wish me all the best i wish my legs would work properley but they dont pity the dwp doubt me but thats there problem not mine i only deal in facts not fiction.........Paul

How do you go about appealing, Am I right in assuming that you have to apply direct to the tribunal and not through the DWP, I also believe that you have to fill in a form and you have to send in a copy of the Manditory Decision with the form?

I hope it all goes well for you Paul, But why did they make their decsion before getting all the facts, I thought they had asked you to provide more evidence regarding your mobility.

Why didnt they wait for that instead of making you have to go for appeal, Isnt it a crazy system???

You may not get as far as the tribunal Paul, I have read that there are quite a few cases of them backing down once they know you are appealing, I hope they do this for you.

I am going to phone today to see if they have received my medical eveidence, I am hopeful to get my decision soon.

If its not good I will be right there with you Paul and going for an appeal.

I just think its so disgusting making people who are sick and vulnerable go through this mental hell, Stress makes Parkinsons worse and this has been one of the most upsetting and stressful things I have gone through.

Yes you have it right you do appeal direct to hm courts and tribunal service.

I read your point about they said they wanted more evidence sending in regarding my mobility and what they referred to as unplanned intervention.

I had contacted my MP and she was in touch with them and pushing for a decision I believe they rushed through the decision because of pressure and by doing so they  awarded the enhanced daily living but no mobility don't forget things were getting quite absurd 26 weeks for the original decision and then 11 weeks for the reconsideration so that wait I believe happened I will be downloading the form and filling it in for the appeal to tribunal.

It should not be long for you now candy good luck let us all know how you get on

Thanks for the explanation Paul, I phoned DWP they said they have received my medical evidence and I should of had a decision by the end of August beginning of September!!!

I requested my reconsideration in June, So It will of been quite a few weeks wait for me also, They have changed their automated message, It now says it can take 26 weeks to get an assessment!! So poor people starting a new claim are in for a ridiculous wait, Even worse than ours if thats possible.

My support worker did suggest re-applying if my reconsideration is turned down, But after hearing that I will go to appeal, I dont think I could face going through all that again.

If I start a new claim I will also lose all my back dated pay which will be from January if I am successful.

Do you guys think I should contact my MP? Does having them on board really help?

I havent done it yet but I would liKe to know your opinion Paul and Shelly, Do you think after your experiences of talking to your MP that they do carry some weight and help speed things along?

Well just another waiting game for me now, 7 months now from my first application.

You never know maybe I will hear before Christmas, LOL

Yes you should contact your mp simply go to google and type the word contact followed by the name of your mp if its the same as me you get the mp's persoal assistant and this is the person who will call and email the dwp to tell them your claim is taking to long I f you dont do this and  they will just drag there feet more and more

Thanks thats really good advice,

I am really dreading getting this new decision, I am starting to feel quite de-flated about the whole thing,I do have a horrible feeling that I am going to be turned down again.

The fact that I am being tube fed now due to swallowing and weight loss is not going to make any difference to them, I just know that they are going to turn me down again and at the moment I dont know if I have the energy to go to a tribunal.

I wish I did not feel like this when I am encouraging you to fight on, But I dont think I could go through the whole appeal and sitting in front of a panel. Just dont think I can go through that.

At the moment I think they are going to win.How can I pick myself up out of this, I was so up for it but the fight is leaving me now.

the appeal i think is a judge , dwp , & gp, my mate had one not so long ago when the judge heard how much meds he was on ,he awarded the highest pip ,he  said it lasted about 10mins , he said dwp did not even contest  it.! keep going candy you've got to do it for all the honest people out there !

I would be very surprised if you did not win your reconsideration as I am sure you said on here that you only missed out by 2 points so that means you only got 6 how can that be with parkinsons beats me. Just make sure you have been in touch with your occupational therapist at social services to apply for adaptations to your home such as a perching stool a raised toilet seat a kettle tipper long shoe horn medication pill box a toilet frame a raised chair to help you stand up these things things are useful but they are also worth points as well make sure you have everything in place that you need should you then go to tribunal and they do the maths they wont be able to refuse its done on descripters and the tribunal has to work on points of law not like some decision makers who take points off you just because they feel like it or theres no r in the month keep going keep strong you are not doing anything wrong.....................Paul
